West Virginia False Claims Act

West Virginia has not passed a state version of the False Claims Act. It was considered and approved by the House Judiciary Committee there in 2014 but rejected by the legislature after a 55-42 vote.

A whistleblower with evidence of health care fraud in Medicare or Medicaid can still file a Federal False Claims Act lawsuit and seek recovery of the federal portion of government spending. The federal law permits rewards of between 15 and 30 percent of the recovery.

The West Virginia Whistle-blower Law protects public body (state, county or other government) employees against discharge or retaliation when they report instances of (substantial) waste or (non-technical) wrongdoing.
