Alaska False Claims Act
Alaska is one of a handful of states that does not have a False Claims Act. There have been a few articles online urging the adoption of an Alaska False Claims Act, though. If we hear that the legislature is considering such a law, we will post it here.
An AZ whistleblower with evidence of health care fraud in Medicare or Medicaid may file a Federal False Claims Act lawsuit and seek recovery of the federal portion of government spending. The federal law permits rewards of between 15 and 30 percent of the recovery.
State Whistleblower Laws
Our research into Alaska’s whistleblower laws revealed a few different, but no broad whistleblower reward or retaliation protections for employees of businesses. Instead, here are a few different state protections that we found:
AS §08.668.279: The law is designed to protect nurses who object to improper delegation of physician duties to them. It protects nurses from discharge or other discrimination based on a nurse’s refusal to perform a delegated task involving nursing care if the task was improperly delegated, the nurse reports the improper delegation to the Board of Nursing within 24 hours, and the Board of Nursing finds the task was improperly delegated.
AS §18.60.089: It is similar to the federal law prohibiting reprisals against employees who report unsafe workplaces. Violations of the law are investigated by the Alaska Occupational Safety & Health (AKOSH).
AS §39.90.110, et seq.: It prohibits public employers (the state and city governments) from discharging public employees who report misconduct to a public body or participate in a court action or inquiry.
Alaska employees are also protected by a variety of federal whistleblower laws and programs which entitle them to compensation for retaliation and rewards for information that results in the successful recovery of monetary sanctions.
