Laparoscopic surgery, also known as minimally invasive surgery, involves a small incision to allow access for the doctors to perform the surgery. Medical professionals use a long fiber optic cable system known as the laparoscope to view the area and then perform the surgery and tissue manipulation with tools. Common procedures involve the discovery or treatment of endometriosis, adhesions, ovarian cysts, fibroids, ectopic pregnancy, and procedures such as an appendectomy, cholecystectomy (gallbladder removal), vaginal hysterectomy or tubal ligation.

Surgical errors can and do occur in many medical procedures. Laparoscopic surgery poses additional challenges to open surgery. In some instances, the selection of a laparoscopic procedure over open surgery can itself constitute medical malpractice if it is a deviation from the normal standard of care and results in injury.

Laparoscopic Gallbladder Surgery Malpractice

Malpractice cases also may involve the failure to properly operate and perform the da Vinci robotic surgery. Many cases will involve damage to a bile duct or other injury while removing the gallbladder. Instead of clipping and cutting the cystic duct, a surgeon that fails to confirm the anatomy may damage the common hepatic duct or a bile duct.

Other Types of Laparoscopic Malpractice

The failure to properly identify organs is the root cause of many errors in minimally invasive surgeries. Additionally, performing surgeries with insufficient training and experience in laparoscopic surgical techniques can result in serious injuries and even fatalities.
