NuVasive Magec System Lawsuit
Several reports indicate possible failure of the NuVasive MAGEC system, including complications associated with metallosis, device fracture and tissue death. The NuVasive Magec System is a magnetically controlled growing rod system that is used to treat scoliosis and to prevent a condition called Thoracic Insufficiency Syndrome, which occurs as a result of the disease.
Recent studies have shown, however, that the NuVasive system is one of nine magnetic controlled growing rod systems that have been linked to defects and the need for revisionary surgical procedures. This is all despite the claims by the manufacturer that this product is intended to reduce the likelihood that such procedures would be needed.
Common Defects and Problems
Some of the problems linked to the NuVasive Magec system include the following:
- Failure of the rods to distract when required. Distraction is the lengthening of the rod. When the rods fail to lengthen, an additional surgical procedure may be necessary to correct the concern.
- Bent or broken rods. This can also force doctors to order additional surgeries to correct problems with the hardware and can impact the effectiveness of treatment.
- The need for additional surgeries to repair disengaged hardware. This is counter to the claims made that the system reduces the need for revision surgery.
- Skin discoloration. While this is cosmetic, it can have a negative impact on self-esteem and worth.
The Spine Journal published a study which revealed that there were numerous unplanned surgeries linked to this system, even though NuVasive Specialized Orthopedics has marketed it as an alternative to other systems on the merit that it would require fewer operations over time. Broken and separated rods can also cause serious injuries to the child, resulting in the need for more surgical intervention.
If your child was injured, you may be entitled to recover compensation for the cost of revision surgeries, medical treatment associated with his or her injuries, out of pocket expenses, pain and suffering and more. Contact our team of lawyers today.
